Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of theONE Vessel Command Center (“theONE” or the “app”), operated by JEMS Marine, LLC (“JEMS Marine,” “we,” “us,” or “our”). By accessing or using theONE, you agree to be bound by these Terms. If you do not agree, do not use the app.

2. The Service

theONE is an iOS application that helps captains manage vessel information, including trip planning, charts and weather, telemetry, maintenance, stowage, and crew. theONE is currently in private beta and scheduled to launch in Summer 2026. We do not warrant that the service will be uninterrupted, error-free, or available at all times.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use theONE.

4. Accounts

You are responsible for providing accurate account information, keeping your credentials secure, and for all activity that occurs under your account.

5. Acceptable Use

You agree not to:

• Reverse engineer, decompile, or disassemble the app.
• Use the app for any unlawful purpose.
• Interfere with or disrupt the integrity or performance of the service.

6. Captain's Responsibility / Navigation Disclaimer

theONE is an aid only and is NOT a substitute for proper navigation, official charts, prudent seamanship, or required safety equipment. The captain is solely responsible for the safety of the vessel, crew, and passengers, and for compliance with all applicable maritime laws and regulations. Always rely on official charts and sound judgment.

7. Intellectual Property

theONE, the JEMS Marine marks, and the app itself are owned by JEMS Marine, LLC and are protected by applicable intellectual property laws. These Terms do not grant you any right to use our marks without our prior written permission.

8. User Content

Data you enter into theONE belongs to you. You grant us a limited license to host, process, and use that data solely to operate and provide the service to you.

9. Beta Program

theONE is provided as part of a beta program on an as-is basis. Beta features may change or be discontinued at any time, and we may use your feedback to improve the product.

10. Disclaimer of Warranties

To the maximum extent permitted by law, theONE is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, JEMS Marine, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data. Our aggregate liability for any claim relating to the service is capped at the amount you paid us, if any, in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless JEMS Marine, LLC from any claims, damages, liabilities, and expenses arising out of your use of the app or your violation of these Terms.

13. Termination

We may suspend or terminate your access to theONE at any time, with or without notice, including for violation of these Terms. You may stop using the app at any time.

14. Governing Law

These Terms are governed by the laws of the State of Maryland, USA, without regard to its conflict-of-laws principles. You agree that venue for any dispute will lie in the state or federal courts located in Maryland.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of theONE after changes take effect constitutes acceptance of the revised Terms.
