Terms of Service

1. Acceptance of Terms

These Terms of Service (“Terms”) govern your access to and use of theONE Vessel Command Center (“theONE” or the “app”), operated by JEMS Marine, LLC (“JEMS Marine,” “we,” “us,” or “our”). By accessing or using theONE, you agree to be bound by these Terms. If you do not agree, do not use the app.

2. The Service

theONE is an iOS application that helps captains manage vessel information, including trip planning, charts and weather, telemetry, maintenance, stowage, and crew. theONE is currently in private beta. We do not warrant that the service will be uninterrupted, error-free, or available at all times.

3. Eligibility

You must be at least 18 years old and able to form a binding contract to use theONE.

4. No Accounts

theONE works with no account, and there is no password anywhere in it. There is an optional sign-in by emailed link, which exists so that a second device of yours can reach the same boat; it is not required to use the app. Until you sign in, everything you enter is stored on your device only. What we hold once you do sign in is set out in section 3a of our Privacy Policy. You are responsible for the security of your own device and of any backup you choose to make of it (such as an iCloud or local encrypted iPhone backup), since that is where your vessel data lives.

theONE's safety features are an aid only. They supplement — they never replace — proper seamanship, official charts, required safety equipment, and U.S. Coast Guard and other applicable maritime safety requirements. The captain is solely responsible for the safety of the vessel, crew, and passengers, and for compliance with all applicable maritime laws and regulations, including USCG requirements. Always rely on official charts, required safety equipment, and sound judgment — never on theONE alone.

7. Intellectual Property

theONE, the JEMS Marine marks, and the app itself are owned by JEMS Marine, LLC and are protected by applicable intellectual property laws. These Terms do not grant you any right to use our marks without our prior written permission.

8. Your Data

Data you enter into theONE belongs to you. If you do not sign in, it stays on your device and we hold none of it. If you do sign in, changes to the vessel record travel to our server so your other devices and your crew can receive them, and we hold them there on your behalf — you remain the owner of that data. What we hold, what never travels at all, and how to have an account deleted are set out in section 3a of our Privacy Policy. Other limited paths — optional crash reports or analytics you switch on, or the Founding Captain form on this website — are described there too, and nothing leaves your device unless that policy says so.

9. Beta Program

theONE is provided as part of a beta program on an as-is basis. Beta features may change or be discontinued at any time, and we may use your feedback to improve the product.

10. Disclaimer of Warranties

To the maximum extent permitted by law, theONE is provided “AS IS” and “AS AVAILABLE,” without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, JEMS Marine, LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data. Our aggregate liability for any claim relating to the service is capped at the amount you paid us, if any, in the twelve (12) months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless JEMS Marine, LLC from any claims, damages, liabilities, and expenses arising out of your use of the app or your violation of these Terms.

13. Termination

During the beta, we may remove you from the TestFlight beta at any time, with or without notice, including for violation of these Terms, which stops further beta builds from reaching you. If you have signed in, we may also end that account’s sessions, which stops it reaching our server. Neither reaches into the app or the data already on your device: what is on your phone stays on your phone, and we have no way to delete or alter it remotely. You may stop using theONE at any time by deleting it from your device.

14. Governing Law

These Terms are governed by the laws of the State of Maryland, USA, without regard to its conflict-of-laws principles. You agree that venue for any dispute will lie in the state or federal courts located in Maryland.

15. Changes to these Terms

We may update these Terms from time to time. When we do, we will revise the “Last updated” date at the top of this page. Your continued use of theONE after changes take effect constitutes acceptance of the revised Terms.
